These terms and conditions together with the Policies (defined below) (the “Terms”) provide information about Khamsa Art, and are the legal terms and conditions under which Khamsa Art will place Artworks (defined below) for sale on the Website and deliver the Services (defined below). Khamsa Art reserves the right to alter these Terms at any time. Please ensure to review these Terms frequently so that you are aware of any such changes. If you do not agree to these Terms, then you should not use the Website.
About Us and Our services
Khamsa Art website is hosted at www.khamsart.com and is operated by White Turban Art Consultancy L.L.C-FZ, a company incorporated in Dubai, U.A.E., , company number 2305785.01, having its registered office at Business Center 1, M Floor, The Meydan Hotel, Nad Al Sheba, Dubai, U.A.E. (“Khamsa”, “we” or “us”)
The services we make available through the Website (the “Services”) comprise the provision of an online art marketplace, with website pages and content (each a “Listing”) displaying and advertising the sale of authentic artworks (the “Artwork”) and enabling us to sell Artwork direct to any visitor to the Website (the “Consumer”).
We will provide Consumers with KHAMSA terms of sale (the “Consumer Terms of Use”) which will apply to all sales of Artwork and any services made available on the website.
We may update the Consumer Terms of Use from time to time and all updates will be notified. By accepting these terms and conditions prior to any purchase, you are legally bound to comply with the Consumer Terms.

Below is a list of policies (the “Policies”) referred to in these terms, which should be accepted as they are part of agreement between You and us;
KHAMSA Cancellations and Returns Policy
Please note, your general use of the Website as a visitor, and any purchases of Artwork You may make using the Website are governed by KHAMSA Art “Consumer Terms of Use” which will apply to you in addition to these Terms.
Notification of Orders
KHAMSA Art via its payment fulfilment provider, shall pre-authorise payment once you place your order online, if payment has been made via credit card. You shall receive confirmation email of Orders (“Confirmation Email”) to your nominated notification email address, inclusive of all details necessary for the dispatch of the Artwork. If the payment option is online bank transfer. Once we receive your payment in our account, we will process the order and you shall receive confirmation email of Orders (“Confirmation Email”) to your nominated notification email address, inclusive of all details necessary for the dispatch of the Artwork.
Website Usage
KHAMSA Art shall not be liable for any damages arising from loss of data, whether in action of contract, negligence or other tortious action, arising out of or in connection with the use, or inability to use the Website.
You acknowledge that no Website can ever be guaranteed to operate free of errors or downtime and whilst we will use commercially reasonable endeavors to ensure that the Website remains free from errors or viruses, we cannot accept any liability for downtime caused by events outside our control. You acknowledge that we may from time to time require periods of downtime in order to maintain and update the Website and we will endeavor to carry out such maintenance with as little disruption to the Service as possible.
Liability
KHAMSA Art makes no representations or warranties of any kind to in respect of the Website or the Services. KHAMSA Art shall not be liable for any damages of any kind including without limitation, direct, indirect, incidental, punitive and consequential losses (including loss of profits and loss of data) arising out of these Terms or use of the Website, provided always that nothing in these Terms shall exclude or limit liability arising as a result of negligence, fraud or any other liability which may not be excluded or limited by law. KHAMSA Art shall not be liable for the acts or omissions of providers of telecommunication services or for faults in or failures of their apparatus.
Governance
These Terms and any non-contractual obligations or liabilities arising out of or in connection with these Terms shall be governed by the laws of U.A.E. and the parties submit to the exclusive jurisdiction.
